Draft Agreement

Agreement for distribution of earnings resulting from live performances in the ensemble with Michael Bassett.
Terms of reference for this agreement:
o MB refers to Michael Bassett the individual.
o The ensemble refers to the individuals playing with Michael Bassett and including Michael Bassett during live performance.
o Any individual playing on 70% or more of the material for that night will be considered a member of the ensemble for that night, unless otherwise stipulated.
o Guest Player(s) refer to musicians playing for an agreed fee and therefore are not included in any of the terms specified for ensemble members.
o The Manager will be considered as an additional ensemble member .
Income referred to may be generated through Ticket Sales or a one off fee but does not currently include income generated through the sale of merchandise (see section 5).
Income generated will be distributed as follows:
1) Expenses
Direct expenses related to playing the event will be paid, including travel, food, accommodation, venue hire, publicity costs, Guest Player(s) fees and any other attendant expenditures.
In the event of insufficient income being earned to cover these expenses MB will subsidise these costs. In which case these subsidised expenses will be recorded and repaid to MB when the ensemble is seen to achieve sufficient income to do so, (paragraph 3 of this document).
2) The Ensemble
After direct expenses have been paid, all ensemble members will be paid an equal portion of the earned income, up to the value of £100 per member per performance.
3) Re-imbursement to MB
Whenever the income is sufficient to pay all expenses + £100 to each ensemble member, remaining earned income, up to the value of 10% of gross takings, will be paid to MB to reimburse previously subsidised expenses, as identified in paragraph 1.
4) Remaining Earned Income
When all expenses, ensemble members and re-imbursement to MB (up to 10% of gross takings as specified in paragraph 3) have been paid, remaining earned income will be split equally between ensemble members.
5) Merchandise
Currently the sales from merchandise goes directly to MB to recoup initial outlay. Once this has been recovered then an agreement will be considered regarding the distribution of income earned from these sales.
